Shock Busters | Commercial Service & Supply Agreement

1. Agreement & Operational Scope
These Terms and Conditions govern all commercial safety testing, asset inspections, equipment supply, and compliance services provided by Shock Busters across New South Wales, the Australian Capital Territory, and Queensland.
By engaging Shock Busters to perform electrical safety testing (AS/NZS 3760), RCD testing, smoke alarm compliance, portable fire protection maintenance (AS 1851), or to supply safety hardware and equipment, the Client agrees to be bound by the terms set out in this agreement.
2. Sale & Supply of Safety Equipment
Where Shock Busters supplies hardware, fire protection units, electrical fittings, or safety equipment:
- Standards & Fitness for Purpose: All products supplied (including fire extinguishers, fire blankets, smoke alarms, heavy-duty electrical plugs, and replacement leads) comply with applicable Australian Standards.
Shock Busters ensures goods supplied match quoted specifications. - Manufacturer Warranties: Equipment supplied carries the relevant manufacturer’s warranty. Shock Busters will assist the Client with legitimate warranty claims for manufacturing defects, but does not cover product failures resulting from site vandalism, environmental exposure, physical impact, or unauthorized tampering post-installation.
- Risk & Transit: Risk of loss or damage to supplied equipment passes to the Client upon physical delivery or installation at the Client’s site.
- Returns & Restocking: Custom-ordered items, specialized safety apparatus, or electrical components fitted to site specifications cannot be returned unless verified as defective.
Standard stock returns incur inspection and restocking fees where applicable.
3. Site Access & Client Obligations
To enable Shock Busters technicians to complete inspections and installations efficiently and safely, the Client agrees to provide:
- Unrestricted Access: Clear, safe access to all relevant workspace areas, distribution boards, ceiling-mounted smoke alarms, fire extinguishers, and electrical appliances at the scheduled appointment time.
- Site Hazards & Inductions: Prior notice of any site-specific safety hazards, inductions, or personal protective equipment (PPE) requirements applicable to the facility.
- Operational Disruption & RCD Outages: Cooperation regarding temporary power interruptions required during RCD trip-time testing or circuit isolation.
Shock Busters takes all reasonable steps to coordinate power breaks with site staff to prevent data loss or machinery disruption. - Accurate Site Information: Accurate information regarding site asset counts, floor plans, and access limitations prior to field mobilization.
4. Failed Assets & Isolation Protocol
Shock Busters prioritizes site safety and strictly enforces defect isolation in accordance with statutory standards:
- Failed Electrical & Fire Assets: Any appliance, lead, power tool, smoke detector, or fire protection unit that fails testing or reaches statutory expiration will immediately receive a prominent red DANGER / FAILED – DO NOT OPERATE tag.
- Removal from Service: Technicians will isolate or remove non-compliant items from active use where practical and immediately alert site management.
- Client Responsibility: The Client assumes full legal responsibility if site personnel remove a failed tag or reconnect/use a non-compliant item after Shock Busters has tagged and logged the defect.
5. Pricing, Invoicing & Payment Terms
Service pricing and invoicing conditions are structured as follows:
- Quotation Scope: Rates are based on per-test pricing, minimum site visit fees, or agreed contract rates as quoted. Additional replacement parts or supply items (e.g., replacement smoke detectors, heavy-duty electrical plug replacements, fire blankets, fire extinguishers or backup batteries) will be charged at current schedule rates.
- Payment Terms: Invoices are issued upon completion of testing and are payable within 7 days from the date of invoice, unless otherwise agreed in writing.
- Retention of Title: All goods, tags, replacement fire extinguishers, smoke detectors, components, and hardware supplied by Shock Busters remain the legal property of Shock Busters until full payment of the invoice has been received.
- Reporting Release: Official digital compliance asset registers and certificates of compliance are released upon payment or issued in accordance with active account credit terms and established customer relationships.
6. Default & Debt Recovery Expenses
Overdue accounts incur recovery administrative costs as detailed below:

In the event of the customer being in default of their obligation to pay and the overdue account is then referred to a debt collection agency or law firm for collection, the commission payable and the legal costs incurred on an indemnity basis shall be added to the amount outstanding and form part of the debt.
7. Public Liability, Insurance & Limitation of Liability
Shock Busters maintains comprehensive corporate insurance coverage for commercial operations:
- Insurance Coverage: Shock Busters maintains active $20,000,000 Public & Product Liability Insurance across NSW, ACT, and QLD. Certificates of Currency are available upon request.
- Point-in-Time Inspection Notice: Safety testing and inspections conducted under AS/NZS 3760 (In-Service Electrical Safety), AS 1851 (Routine Service of Fire Protection Systems), AS 2293 (Emergency Escape Lighting & Exit Signs), and AS 3786 / NCC (Residential & Commercial Smoke Alarms) confirm an asset’s operational condition at the exact moment of testing. Shock Busters is not liable for subsequent battery degradation, power surges, environmental contamination, physical misuse, vandalism, unauthorized modifications, or faults occurring after the inspection date.
- Cap on Indemnity: To the extent permitted by Australian Consumer Law, Shock Busters’ total liability for any loss, damage, or legal claim arising from services rendered or goods supplied shall be limited strictly to the cost of replacing/re-supplying the item or service, or the total value of the invoice paid for the specific job site.
8. Cancellations, Access Failures & Site Delays
We operate scheduled mobile technician runs across regional and metropolitan routes:
- Cancellation Window: Cancellations or booking alterations must be made at least 24 hours prior to the scheduled site appointment.
- Abortive Call / Standing Time: If a technician arrives at a site but is denied access, turned away due to site unreadiness, or held up for extended periods due to locked/unaccessible rooms, Shock Busters reserves the right to charge a standard call-out fee or hourly standing rate.
